Rental Terms and Conditions for Comfy Stylish Stay Located in Malaga, Spain

These Terms and Conditions ("Agreement") constitute a legally binding agreement between you ("Guest" or "Guests") and Iryna Akopian, the owner/manager ("Host" or "We") of the property located at at Calle Refino, 22 in Málaga (the "Property"). By booking and confirming your stay at the Property, you agree to comply with and be bound by these Terms and Conditions. Please read them carefully.


1. Booking and Guest Information

  • Booking Confirmation: Your booking is confirmed upon receipt of full payment
  • Minimum Age: The primary Guest making the booking must be at least 21 years old.
  • Maximum Occupancy: The maximum number of occupants allowed at the Property is 4 persons. This number includes adults and children. Exceeding this limit without prior written consent from the Host will result in immediate termination of the reservation and forfeiture of all payments.
  • Guest Identification: As required by Spanish law (Organic Law 4/2015 for Citizen Security and Royal Decree 933/2021), all Guests over 14 years of age must provide a copy of their valid government-issued identification (passport or national ID card) prior to or upon arrival. This information will be registered with the local authorities. Failure to provide this information will result in denial of entry without refund.
  • Rental Fees: The total rental fee, cleaning fees, and any other charges are as displayed on the website at the time of booking.
  • Payment: All payments are processed in full via credit card at the time of booking.

2. Check-in and Check-out

  • Check-in: Our standard check-in time is 3:00 PM onwards on the arrival date.
  • Check-out: Our standard check-out time is 11:00 AM on the departure date.
  • Late Check-out/Early Check-in: Subject to availability and prior arrangement with the Host. Additional fees may apply. Unauthorized late check-out may result in a charge equal to one night's stay.
  • Key Access: You will receive a key code to access the apartment 24 hours before your arrival, following the completion of your guest registration.

3. Property Rules and Conduct

  • No Smoking: Smoking is strictly prohibited inside the apartment.
  • No Pets: Pets are not allowed on the property.
  • No Parties or Events: Parties, large gatherings, and events are not permitted.
  • Cleanliness: The Property should be left in a reasonably tidy condition upon departure. While a cleaning fee is charged, it covers standard cleaning. Excessive mess requiring deep cleaning will incur additional charges.
  • Damage to Property: Guests are responsible for any damage to the Property or its contents caused by their negligence or willful acts during their stay. The cost of repair or replacement will be charged to the Guest. Please report any accidental damage immediately.
  • Appliances and Utilities: Please use appliances responsibly. Turn off air conditioning/heating when leaving the property or when windows/doors are open. Conserve water and electricity.
  • Quiet Hours: To respect our neighbors, please observe quiet hours from 10:00 PM to 8:00 AM.

4. Cancellations

  • 60 Days Prior: A full refund will be issued for cancellations made 60 days or more before the scheduled arrival date.
  • 30 Days Prior: A 50% refund will be issued for cancellations made between 30 and 59 days before the scheduled arrival date.
  • Less than 30 Days: No refund will be issued for cancellations made less than 30 days before the scheduled arrival date.

5. Host's Rights and Responsibilities

  • Right of Entry: The Host or their authorized representatives may enter the Property for necessary maintenance, repairs, or inspections, with reasonable prior notice to the Guest, except in emergencies.
  • Maintenance and Repairs: The Host commits to keeping the Property in good working order. While every effort is made to address issues promptly, no refunds or rate adjustments will be made for equipment or appliance failures outside of our control.
  • Liability: The Host is not liable for any loss, damage, or injury to Guests or their property, except where caused by the Host's gross negligence or willful misconduct. Guests are advised to have appropriate travel insurance.
  • Emergency Contact: An emergency contact number for the Host or local representative will be provided at the Property.

6. General Information

  • Cleaning: A mandatory cleaning fee of €50 is applied to your booking.

7. Legal and Regulatory Compliance (Malaga, Spain)

  • Andalusian Tourist Registry (VFT) Number: This Property is legally registered with the Junta de Andalucía for tourist purposes under the registration number: VFT/MA/[Your VFT Number]. This number is displayed on all advertisements for the Property, as required by law.
  • Guest Registration (Police Records): As per Spanish law, the Host is legally obliged to collect passport/ID details from all guests over 14 years old and transmit this information to the Spanish police (Guardia Civil/Policía Nacional) within 24 hours of check-in. This is for security purposes.
  • First Aid Kit & Emergency Information: A well-equipped first aid kit is available at the Property. Emergency contact numbers (local emergency services, hospital, Host's contact, backup contact) are prominently displayed.
  • Air Conditioning/Heating: The property is equipped with air conditioning (mandatory May-September) and heating (mandatory October-April) as required by Andalusian regulations. Instructions for use are provided.
  • Homeowners' Community Approval: The Host confirms that, if required by the building's Horizontal Property Law amendments in Malaga, the necessary community approval for tourist rental activity has been obtained. Guests are expected to respect the community rules.
  • Tourist Information: Basic tourist information, including local attractions, public transport, and emergency services, will be available at the Property.
  • Complaints and Claims: Official complaints and claims forms (Hojas de Quejas y Reclamaciones) are available at the Property, as required by Andalusian tourism regulations.

8. Governing Law and Jurisdiction

  • This Agreement shall be governed by and construed in accordance with the laws of Spain and, specifically, the regional laws of Andalusia, without regard to its conflict of law provisions. Any disputes arising from or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts of Malaga, Spain.

9. Amendments

  • The Host reserves the right to amend these Terms and Conditions at any time. Any changes will be posted on the Airbnb listing and will apply to bookings made after the updated terms are published.

10. Acknowledgment

  • By proceeding with this booking, you acknowledge that you have read, understood, and agree to these Terms and Conditions.
